DMCA Policy
Last updated: January 1, 2025
1. Copyright Infringement Policy
PlagCheckr respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated Copyright Agent.
While we are a Nepal-based company, we voluntarily comply with DMCA takedown procedures to protect the rights of content creators worldwide. This policy applies regardless of the jurisdiction in which the copyright holder resides.
2. Filing a Copyright Complaint
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify our Copyright Agent. For your complaint to be valid under the DMCA, you must provide the following information in writing:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send copyright infringement notifications to our Copyright Agent via email at [email protected].
3. Takedown Procedure
Upon receiving a valid DMCA notification, we will:
- Acknowledge receipt of your complaint within 2 business days
- Review the complaint for completeness and validity
- Remove or disable access to the allegedly infringing material within 7 business days if the complaint is valid
- Notify the affected user of the takedown and provide them with a copy of the notification
4. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts of Nepal and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person
Upon receiving a valid counter-notification, we will forward it to the original complainant. The original complainant then has 10 business days to file a court action seeking to restrain the allegedly infringing activity. If no court action is filed within 10 business days, we may restore the removed content.
5. Repeat Infringers
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
A user will be considered a repeat infringer if:
- Two or more valid DMCA takedown notices are filed against the user
- A single DMCA notice is filed for material that clearly constitutes willful infringement
- The user has a demonstrated pattern of uploading infringing content
6. Limitations
This DMCA policy applies specifically to content uploaded by users to our Service for analysis. It does not apply to:
- Reports generated by our AI analysis tools (which are derivative works based on user-uploaded content)
- Content on external websites that our plagiarism detection references
- The PlagCheckr platform code, design, or branding (which are protected by our own intellectual property rights)
