Terms of Service

1. Acceptance of Terms

By accessing or using PlagCheckr ("the Service"), operated by PlagCheckr ("the Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Service constitutes acceptance of any modifications.

2. Account Terms

To use certain features of the Service, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Be at least 13 years of age to create an account

One person or entity may not maintain more than one account. We reserve the right to suspend or terminate accounts that are found to contain false or misleading information.

3. Description of Service

PlagCheckr provides an AI-powered platform for plagiarism detection and AI-generated content identification. The Service allows users to upload documents for analysis and receive reports indicating the likelihood of AI-generated content and similarity to existing sources. The Service operates on a credit-based system where each document analysis consumes one (1) credit.

4. Credit System and Purchases

The Service uses a prepaid credit system. Credits are purchased in packages and are consumed when document analyses are performed. The following terms apply:

• Each document analysis consumes one (1) credit regardless of document length
• Credits expire based on the validity period of the package purchased (10, 15, or 30 days), or never expire on the Starter package
• Credits are non-transferable between accounts
• All credit purchases are final and non-refundable, except in cases of a system error on our side (payment taken but credits not delivered, or duplicate charge)
• Free welcome credits, if any, are consumed after purchased credits that are due to expire soonest
• We reserve the right to adjust pricing with 30 days' notice

5. Acceptable Use

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Prohibited uses include but are not limited to:

• Uploading content that violates intellectual property rights of others
• Attempting to gain unauthorized access to the Service or its systems
• Using automated tools to interact with the Service without authorization
• Reselling or redistributing report results without proper licensing
• Uploading malicious files or content designed to exploit the Service
• Circumventing usage limits or credit system mechanisms
• Using the Service to harass, threaten, or harm others

6. Intellectual Property

The Service, including all software, content, trademarks, and logos, is the property of PlagCheckr and is protected by intellectual property laws. You retain ownership of any documents you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you. We do not claim ownership of your uploaded content or generated reports.

7. Accuracy and Disclaimer

While we strive to provide accurate and reliable analysis, PlagCheckr makes no warranties about the completeness, reliability, or accuracy of the Service. Report results are generated by artificial intelligence and should be used as a guideline, not as a definitive judgment. The Service is not a substitute for human review. We strongly recommend using report results as one of multiple evaluation tools.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PlagCheckr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid for credits in the twelve (12) months preceding the claim. The Service is provided "as is" without warranties of any kind, either express or implied.

9. Indemnification

You agree to indemnify, defend, and hold harmless PlagCheckr, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal. Both parties agree to attempt to resolve any dispute through good faith negotiation before initiating legal proceedings.

11. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Service, the parties shall first attempt to resolve the dispute through informal negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may initiate mediation under the rules of the Nepal Mediation Council. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in Kathmandu, Nepal.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. We will provide reasonable notice of significant changes that affect existing paid services.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
